Terms and conditions for the provision of services by VolnaMoney

This agreement is concluded between the VolnaMoney website, which provides electronic currency exchange services (hereinafter referred to as the Service), and individuals using these services (hereinafter referred to as Users). VolnaMoney is an online platform designed for electronic money transactions. When accessing the site for the first time, the user automatically accepts the terms of use, which are set out in the user agreement. This agreement comes into force from the moment of its adoption and obliges the user to comply with all the provisions and norms set out in the document.

Application payment rules:

1. Payment for the application must be made exclusively using the bank card specified in the details. Otherwise, there is a risk of loss of funds.
2. To pay for the application, you must use only a personal bank card or an electronic wallet.
3. The transfer of funds must be carried out in full in one payment, without a fractional part. If the amount is 7777.77 rubles, the amount of 7777 rubles must be indicated in the transfer details. 4.After completing the payment, you must provide a receipt in electronic PDF format. The receipt and the application must contain the correct personal data and the details of the card or account.
4. Payment for the application must be made before the expiration of the set timer on the payment page. Otherwise, there is a risk of loss of funds.
5. All operations related to the transfer of funds in cryptocurrency are subject to an Anti-Money Laundering (AML) verification procedure.
6. In case of violation of the established rules, identity verification will be REQUESTED, as well as money blocking FOR an INDEFINITE PERIOD.

TERMS OF USE OF THE SERVICE:

1. You confirm that at the time of registering an account or using the services of the Service as an individual (we do not work with individual entrepreneurs, limited liability companies, joint-stock companies, etc.) you are 18 years old and have full legal capacity and understanding of the terms of use of the Service. Underage users have the right to access the website and the opportunity to view its content. However, they do not have the right to initiate the order processing process. In order to ensure compliance with legal regulations aimed at protecting the rights of minors, the system has the right to request confirmation of the user`s age at any time.
2. When submitting a request for an electronic money exchange operation, including currency transfers, it is required to provide documentary evidence of the legality of the origin of these financial assets.

3. You confirm that the application submitted by you, it is mandatory and cannot be changed after submitting a request for its execution.

   Refund requirements are subject to satisfaction exclusively for users who have passed verification, and only if the Service has not yet fulfilled its obligations in full. Refunds are made to the user`s account, minus a commission fee of 2% (when using cryptocurrencies) or 10% (when using fiat currencies).

   In case of deviation of the market rate from the current value by more than 0.1% before the completion of the transaction and confirmation of the set number of transactions, the exchange platform has the right to issue a refund or make an exchange at the current market rate in effect at the time of execution.

4. When the Service fulfills its obligations and funds are credited to the User`s current account., The transaction is considered fully executed and is not subject to cancellation or revision. You confirm that all orders are subject to a mandatory payment verification procedure through the VolnaMoney system, which does not provide for acceptance of the order by the VolnaMoney service.
5. All applications that you have submitted will be considered your offer to purchase your selected digital assets in the amount specified in the application, provided that you comply with these terms of use.
6. VolnaMoney has the right to cancel, terminate, modify or cancel an order in whole or in part, regardless of its status, including cases after confirmation and payment, with or without prior notice. We are not obligated to compensate for losses or compensation to any party in connection with the implementation of these actions.
7. Upon completion of the application form filling procedure, you have the right to change or cancel, provided that the activation of the "Create application" button has not been performed.
8. Payment of the application must be made within 20 minutes from the moment of its creation! If the payment is not made within the specified period, a full verification procedure will be requested for the identity of the bank card holder.

9. You are required to make the payment upon Request within 20 minutes using the details specified in the Application. Otherwise, the Service has the right to terminate the Service agreement unilaterally.

   Transfers to bank cards are carried out through a payment service and can take from 10 to 300 minutes. In exceptional cases, the process can last up to 24-72 hours.

10. If funds are credited to the Service`s accounts after the cancellation of your application, monetary units can be refunded after deducting the commission if the service still has access to these accounts.

11. Users are required to provide us with accurate and complete account information, as well as all requested information. All transactions conducted on the basis of false account data are considered final and irreversible.

    *The user is given a twenty-day period to establish contact with us via the e-mail address specified when making the application. This is necessary to provide all the required information requested by the service. If this condition is not met, the funds will be blocked and non-refundable.

12. In case of rejection, cancellation or cancellation of an order by the service, all financial transactions made in connection with this order will be refunded. The Service reserves the right to regulate the volume of your order or the number of applications submitted by you.

13. The Service has the right to refuse to provide services to certain individuals or legal entities at its discretion, with or without justification.

    * The Service is authorized to selectively verify users before performing exchange operations on the site. It should be noted that this procedure is not mandatory: every client has the right to refuse it without any consequences.

14. In case of detection of signs of illegal activity related to fraud, we have the right and are obliged to notify the relevant competent authorities about the revealed facts.

15. If the User is unable to transfer funds in full, as specified in the order, with the exception of all applicable fees, the service has the right to take the following measures at its discretion:

    • a) Reduce the order volume to the amount of funds actually received;
    • b) Place a new order for the amount of funds actually received at the current exchange rate at the time of entering the new order;
    • c) Cancel a previously created order in accordance with the established procedures, excluding all applicable fees.

16. If the User transfers funds in excess of the amount required to complete the order., after deducting all applicable fees, the Service is entitled to:

    • a) Adjust the order according to the exact amount of funds received;
    • b) Place a new order for the amount of excess funds at the current exchange rate at the time of placing the new order;
    • c) Refund the excess funds to the User after deducting all fees charged.

    Money transfer transactions are considered final and irreversible, except in situations where, regulated by the relevant conditions.

17. It is hereby recommended to provide Users with an up-to-date contact phone number to enable prompt communication with Customer Service representatives in case of additional questions or the need to clarify details. If it is impossible to establish contact with the User regarding controversial issues, the Service reserves the right to cancel pre-placed orders.

    When applying, please provide an up-to-date email address to which you have full and permanent access. In case of disputes related to your application, we will be obliged to request all information sent to you by e-mail from our service. The specified mailbox contains all valid data related to your application. We are ready to provide you with all the necessary information to resolve any issues that may arise. However, if you do not have access to the specified email address and are unable to provide the requested information, we will not be able to provide you with the necessary support.

    We strongly ask you to treat this point with the utmost seriousness and responsibility, given its importance for effective cooperation and prompt resolution of possible problems.

18. The Service is not responsible for delays, failures or other technical problems that occur during the transfer, receipt or execution of orders, transfer of funds, making payments or transmitting information caused by circumstances or malfunctions of systems beyond its control. Employees, agents, or affiliated companies of the Service are also not responsible for possible losses or damage caused as a result of events or technical malfunctions beyond their control.

    * If necessary, the exchange office may request all the necessary documents to confirm the payment, including, but not limited to, a receipt, a bank statement in PDF format and a video recording from the client`s personal account in the banking application.

    * Procedure for consideration of disputed issues related to payments, It is carried out in the period from 10:00 to 22:00 Moscow time.

19. If funds are received from third parties, the request will be rejected without delay.
20. The user is obliged to ensure the confidentiality and protection of his password. In case of loss or misuse of the password by the user, the service is not responsible for possible negative consequences.

21. The User is solely responsible for providing detailed, reliable and accurate information necessary to fulfill orders.

    We reserve the right to make changes, additions, modifications or deletions to any terms and conditions of this document and/or the Services at any time without prior written notice to the user. In the event of significant changes to the Terms, we will take all reasonable steps to post a corresponding notice on the website and/or send you an email (if you have provided us with a valid email address) about such changes. Continued use of the Services after making changes to these Terms will be considered as the user`s full and unconditional consent to such changes. If any changes to these Terms are unacceptable to you, the only acceptable action is to stop using the Services.

Responsibility

1. In case of illegal actions against the User by third parties, the Service is released from liability for any losses and harm caused to the User.
2. The Service is not responsible for the refusal or non-fulfillment of the User`s request by the bank or the payment provider specified in the request. In case of errors on the part of the bank or the payment system, the User must send the relevant claims directly to the specified organizations. The Service undertakes to assist in the settlement of the User`s claims by providing the necessary documents and information.
3. The Service is not responsible for delays or technical failures that occur during the transfer, receipt, execution of orders, money transfers, payments or information transfer caused by circumstances or technical problems beyond its control. Employees, agents, or affiliated companies of the Service are also exempt from liability for any loss or damage resulting from these circumstances or technical problems.
4. The User undertakes to refrain from actions that may cause damage to the Service. Such actions include unauthorized access to the database, fraud, distribution of malicious software, as well as the posting of materials that do not belong to the Service. In addition, it is prohibited to encourage actions aimed at disrupting the normal functioning of the Service or committing fraudulent acts against other Users. You must also not interfere with the operation of the Service, the servers, or the networks on which it operates, or violate any laws, rules, requirements, procedures, or policies established for those servers or networks.
5. The User must promptly notify the Service administration of any changes to their credentials, including their email address and phone number. This can be done through your Personal Account by updating the relevant data. In the event of an untimely data update, the Service is not responsible for the possible negative consequences associated with the User`s failure to receive notifications and security codes on time. 6 In case of suspicion of unauthorized access to the account, possible hacking or compromise of passwords, the user is obliged to immediately notify the administration of the Service.
6. The user of this service undertakes not to use tools designed to disguise his geographical location. At the request of the service administration, the user must provide reliable information about his location. Otherwise, the user`s actions may be classified as suspicious. The Service reserves the right to refuse to process the request, not to execute it, or to block the user`s account.
7. The Service is not responsible for user actions related to visiting web resources or social networks that mimic the address of the official website of the service or create fake accounts on social networks. In case of discovery of such resources or pages, the user is obliged to immediately notify the administration of the service.
8. If the user refuses to provide additional information or relevant documents, the service administration has the right to suspend the transaction or block the account until all circumstances are clarified.
9. The Service undertakes to ensure the provision of exchange services on time and in full, strictly observing the terms of this Usage Agreement.
10. The Service undertakes to provide timely and reliable information to Users about any changes regarding the terms of use, payment methods and the amount of fees charged. Information about the amount of the commission is provided to Users at the time of registration of the application for their convenience.

Data usage

The Service can collect both personal and non-personalized data using various technologies, including web analytics, data analysis, cookies, and monitoring mechanisms. This data can be obtained either as a result of the user`s voluntary provision of information, or through the use of other technical means. All information transmitted through the website is considered to have been collected based on the user`s prior consent.
